This extended warranty applies to goods sold by N&A Manufacturing Pty Ltd (trading as Gworks) (Gworks).
1. Rights under the Australian Consumer Law
Our goods come with guarantees under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits conferred by this extended warranty are in addition to your rights under the Australian Consumer Law.
2. Coverage of Extended Warranty
2.1 Warranty provided
(a) Goods sold by Gworks (Goods), when used in normal conditions in accordance with their specifications and our maintenance recommendations and safety warnings, will be free from defects in material and workmanship for the period specified in section 2.2 (Extended Warranty).
(b) The Extended Warranty is provided for no fee with all Goods.
(c) Subject to the exclusions set out in section 2.3, if a Good is defective in material or workmanship, Gworks will either repair or replace the Good (at its absolute discretion).
(d) Gworks is not liable for any losses, damages, costs or expenses incurred or suffered by you or anyone else, due to a defect in a Good other than the costs associated with the repair or replacement of the Good as set out in this Extended Warranty.
2.2 Period of warranty
(a) Subject to clause (b), the Extended Warranty is for a period of 12 months, commencing on the date on which Gworks notifies you that installation of the Good is complete and your vehicle is available for collection from Gworks.
(b) The Extended Warranty for the following components of the Goods:
(i) the structural internal canopy framework;
(ii) welding to the tray and canopy;
(iii) the tray mount; and
(iv) the structural tray framework,
(v) a period equivalent to the lifetime of the original end-user purchaser; or
(vi) where the original end-user purchaser is a corporation, a period of 10 years, commencing on the date on which Gworks notifies you that installation of the Good is complete and your vehicle is available for collection from Gworks.
The Extended Warranty does not apply to defects arising as a result of:
(a) misuse (including use other than in accordance with the specifications or intended use), neglect or mistreatment;
(b) improper maintenance;
(c) the use of accessories not manufactured by Gworks;
(d) failure by the purchaser to comply with all applicable laws;
(e) external influences such as accident, fire, extreme weather, vandalism or climatic effects such as damage caused by salt water or sand;
(f) general wear and tear; or
(g) repairs, modifications or alterations not performed by Gworks.
1. The Extended Warranty is limited to the original end-user purchaser of the Good and will expire upon transfer of the Good to another individual or entity.
3. Extended Warranty Claims
3.1 What to do when a Good is defective
If you suspect that a Good is defective, you must promptly contact Gworks to make a claim in accordance with section 3.2 and, if directed by Gworks, immediately cease using the Good.
3.2 How to claim
(a) To make a claim under this Extended Warranty, you must contact Gworks via email or telephone using the contact details set out in section 4. Gworks requires the following information in order to process your claim:
(i) your name;
(ii) your contact information including contact phone number and email address;
(iii) details of the Good, including any reference number recorded on your invoice;
(iv) details of the alleged defect(s) including the specific component of the Good affected, a description of the alleged defect(s) and photos which evidence the alleged defect(s); and
(v) any additional evidence or information that you wish to provide or is otherwise reasonably required by Gworks.
(b) Unless otherwise agreed, Gworks also requires that you make the Good available at its nearest workshop to you for inspection and testing. Unless otherwise agreed, you will deliver the Good to Gworks for inspection, testing.
3.3 Responding to a claim
(a) Gworks will respond to your claim within 5 business days of receipt and, if required, make arrangements for the delivery of the Good to Gworks for inspection and testing.
(b) Gworks will advise of the outcome of your claim, including whether the Good will be repaired or replaced, within 10 business days of the Good being delivered to Gworks or, if Gworks does not require delivery of the Goods to its workshop, within 10 business days of the date that Gworks responds to your claim under clause 3.3(a).
(c) If Gworks determines that the Good has a defect which is covered by the Extended Warranty, Gworks will promptly either:
(i) repair or replace the Good (as it determines in its absolute discretion) and make the Good available for collection once repair or replacement is complete; or
(ii) send a replacement for the Good to you in which case you will be responsible for the installation of the replacement Good, and the claim will be closed.
(d) If you do not provide information reasonably requested by Gworks or do not make the Good available for inspection and testing as required by Gworks, the claim will be closed. If the claim is closed, you will not be able to submit a subsequent claim in relation to that defect under this Extended Warranty. This does not prevent you from submitting a subsequent claim if you believe there is a different defect in the Good
